Terms of Service

1. Acceptance of Terms

By accessing or using the FairSplit website and services (the "Service"), you agree to be legally bound by these Terms of Service ("Terms"). If you do not accept these Terms, you must not use the Service.

2. Service Description

FairSplit provides an indicative, without prejudice pension division calculator to assist individuals and professionals in exploring possible pension sharing and offsetting scenarios during divorce.

The Service:

  • Calculates indicative Pension Sharing Order percentages (PSO%)
  • Estimates offset values and retirement income projections
  • Uses standard calculation methodologies aligned with PAG2 (2024) guidance

FairSplit is not:

  • A regulated financial advice service
  • A legal advice service
  • A substitute for qualified advice from a PODE, actuary, solicitor, or IFA
  • A formal or court-admissible expert report

3. Payment Terms

3.1 Fixed Fee

Each pension calculation is charged at a one-off fixed fee of £100 (GBP).

3.2 Secure Payment

Payments are processed via Stripe, our secure third-party payment provider. By paying, you agree to Stripe's terms and conditions.

3.3 Refunds

Fees are non-refundable, except where:

  • A technical fault prevented you from using the Service
  • You accidentally submitted a duplicate payment

Refunds must be requested within 14 days and are reviewed individually.

3.4 VAT

All prices are inclusive of VAT where applicable.

3.5 Price Changes

Pricing may change at any time, but updates will not affect previous payments.

4. User Obligations

When using the Service, you agree to:

  • Input data truthfully and accurately
  • Use the tool only for lawful and non-commercial purposes
  • Not resell, distribute, or licence the outputs without our consent
  • Not reverse-engineer, scrape, or interfere with the system
  • Acknowledge that all results are indicative only and require professional interpretation

5. Intellectual Property

All content, software, logic, algorithms, branding and design belong to FairSplit Ltd and are protected under UK and international law.

You are granted a non-transferable, limited licence to use the Service for personal, private use only. You may print or export your own calculation results, but may not:

  • Copy or reproduce any part of the site or tool
  • Build derivative products
  • Use FairSplit branding without written permission

6. Limitation of Liability

6.1 Indicative Nature

FairSplit is an indicative-only modelling tool. It is not a substitute for regulated or professional advice.

6.2 No Liability for Outcomes

We accept no liability for decisions, outcomes or losses arising from your reliance on FairSplit outputs. This includes:

  • Legal proceedings
  • Settlement negotiations
  • Implementation of pension sharing orders
  • Use in financial disclosure documents

6.3 Maximum Liability

To the maximum extent permitted by UK law, our liability is limited to the amount you paid for the Service (£100 per use).

6.4 No Consequential Damages

We are not liable for:

  • Financial loss, including poor settlement outcomes
  • Loss of opportunity or income
  • Emotional distress
  • Legal costs
  • Technical or access issues

6.5 Service Interruptions

We do not guarantee uninterrupted availability of the Service. Outages, bugs, or loss of access may occur.

6.6 Statutory Rights

These Terms do not limit any rights you have under UK consumer law, nor do they exclude liability for fraud, negligence causing death or personal injury, or anything else prohibited under statute.

7. No Financial or Legal Advice

FairSplit does not offer:

  • Financial advice regulated by the Financial Conduct Authority (FCA)
  • Legal advice under SRA or similar regulation
  • A formal expert witness or PODE opinion

You must seek independent professional advice before relying on FairSplit for any legal or financial settlement decisions.

8. Accuracy and Assumptions

Calculations depend on:

  • User-entered data (which we do not verify)
  • Standard actuarial assumptions (e.g. inflation, mortality, growth)
  • Methodologies aligned with PAG2 (2024) and simplified for usability

Limitations include:

  • Scheme-specific features (e.g. safeguarded benefits, GARs) may not be captured
  • Outputs are not suitable for use in court or as expert evidence
  • Results are only as accurate as your inputs

We strongly recommend obtaining a full actuarial report for any complex case.

9. Indemnity

You agree to indemnify FairSplit Ltd, its directors, employees and agents against any claim, liability, loss or cost (including legal fees) arising from:

  • Your breach of these Terms
  • Your misuse of the Service
  • Any legal action resulting from your reliance on the results

10. Termination

We reserve the right to suspend or terminate access where:

  • You breach these Terms
  • Unlawful or suspicious activity is detected
  • Technical or security concerns arise

Termination will not affect rights accrued before the date of termination. Key clauses (e.g. liability, indemnity, IP) will continue to apply.

11. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Insurance & Professional Standards

FairSplit Ltd holds Professional Indemnity and Cyber Liability Insurance provided by Hiscox Insurance Company Ltd (Policy No. PSC10003806290).

This insurance provides protection against claims arising from:

  • Calculation errors or omissions
  • Data mishandling
  • Cyber incidents and system breaches

This insurance is in place as part of our professional standards — but use of FairSplit remains without prejudice, and all results are indicative only.

13. Analytics & Usage Data

The Service uses privacy-focused analytics tools (Google Analytics and Microsoft Clarity) to understand general usage patterns. These tools do not capture pension figures, dates of birth, names, or any personally identifying information.

Analytics data is collected in anonymised, aggregated form for the sole purpose of improving the Service and understanding how users interact with the calculator.

14. Your Rights Under UK GDPR

You have the right to:

  • Access any personal data we hold (if any)
  • Request correction or deletion of that data
  • Restrict or object to certain types of processing
  • Lodge a complaint with the Information Commissioner's Office (ICO)

15. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service constitutes acceptance of the revised Terms.
